Workshop on IT(Amendment) Act, 2008

NASSCOM and DSCI are engaged with government in developing a sound legal regime for Indian industry, including data protection, to promote continued global sourcing and reaffirm India’s position as a trusted sourcing partner. DSCI has contributed to the development of IT (Amendment) Act, 2008, and is part of the committee responsible for formulating National Privacy Bill. It worked with the government to get a clarification on the multiple interpretations of Rules u/s 43A and 79 of ITAA 2008 and has been updating the industry on the salient features of the Act through compilation of FAQs, conferences and by addressing the specific queries of the organizations.

With the experience thus gained, and recognizing the need to provide guidance to the larger sector of the industry on the regulatory and business implications of the Act, DSCI has developed a hands-on program on the IT (Amendment) Act, 2008. The program will feature a series of interactive workshops where a panel of eminent cyber law experts and industry leaders will come together to impart knowledge and actionable suggestions for understanding the Act. The workshop will be moderated by DSCI and will bring its unique experience of having worked with both the sides – the government and industry – in the creation of Indian data protection regime.

The Program will cover the following aspects:

  • IT Act- what it means for organizations and industry verticals, how it impacts business, how do organization comply with ITAA, possible liabilities and punishments
  • Adjudicating officer-role and scope
  • Cyber Crime: What all constitutes cyber crime and major sections covering cyber crime
  • Intermediaries and liabilities
  • How IT Act integrates with Indian Penal Code, Indian Copyright Act & Indian Contract Act along with discussion of few case studies and court rulings.
  • Standard Operating Procedures for taking the first step in data breaches
