Brief On MeitY's Digital Personal Data Protection (Removal of Difficulties) Order, 2026

On 5 October 2026, the Ministry of Electronics and Information Technology notified the Digital Personal Data Protection (Removal of Difficulties) Order, 2026, to address textual and editorial matters under the Digital Personal Data Protection Act, 2023 without imposing new obligations. The Order amends Section 9(1) of the Act to clarify that verifiable consent requirements apply to the personal data of a child or of a person with disability who has a lawful guardian. It also amends Section 10(2)(c)(ii) by substituting 'periodic audit' with 'periodic data audit' to align with the independent data audit requirements for Significant Data Fiduciaries and prevent inconsistent application by regulatory authorities.
