This exploratory note is intended to analyze common trends that have emerged in proposed and enacted digital competition regulations globally and their impact on the global data economy and cybersecurity ecosystem. In its analysis the note draws references from not only the provisions of the draft Digital Competition Bill proposed in India, but also similar provisions in globally proposed or enacted regulations. The intent of this note is not to comment on whether ex-ante regulation of digital markets is a necessity, rather it is to highlight how certain requirements under these regulations may have unintended consequences for the digital economy and established security best practices.
